These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“you” or “your”) and Hugo Writes, operated by Naratour d.o.o., Kurirski put 26, 51000 Rijeka, Croatia, EU (“company,” “we,” “us,” or “our”). These Terms govern your access to and use of the Hugo Writes website, AI tools, and related services (collectively, the “Services”). By accessing or using the Services, you confirm that you have read, understood, and accepted these Terms.
If you do not agree with these Terms, you are prohibited from using the Services and must discontinue use immediately.
1. Introduction
1.1 Hugo Writes provides AI-assisted writing tools that allow users to draft, revise, and humanize text for personal, professional, or educational purposes.
1.2 We may modify these Terms at any time without prior notice. The “Last Updated” date reflects the latest changes. Continued use of the Services constitutes acceptance of the revised Terms.
1.3 Users are responsible for reviewing these Terms periodically.
2. Age Restrictions and Parental Consent
2.1 The Services are intended for users who are at least 18 years old. Persons under 18 may not register for or use Services that collect personal data.
2.2 If you are under the legal age of consent in your jurisdiction, you may not use the Services without verifiable parental consent.
3. User Representations
By using the Services, you represent and warrant that:

Your use of the Services is lawful and does not violate any applicable law or regulation.
You will not use automated methods (bots, scripts, scraping tools) to access the Services without permission.

4.2 We reserve the right to remove, reclaim, or change usernames deemed inappropriate or offensive.
4.3 Any activity under your account is your responsibility. Notify us immediately if you suspect unauthorized access.
5. Our Services and Third-Party Content
5.1 The Services may include AI-generated content, integrations, or advertisements from third parties. We do not control or endorse third-party content and are not responsible for its accuracy or legality.
5.2 Any interactions with third-party websites or services are solely between you and the third party.
5.3 We reserve the right to monitor, manage, restrict, or remove any content or access to the Services to maintain proper functionality or address violations.
5.4 The Services are not specifically tailored to comply with industry-specific regulations (e.g., healthcare or financial services). Users whose use would require such compliance may not use the Services.
6. User-Generated Contributions and License
6.1 You are solely responsible for content you create, submit, or share through the Services (“Contributions”).
6.2 By submitting Contributions, you grant Hugo Writes a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license to use, reproduce, modify, publish, distribute, display, and perform your Contributions in any media, including for commercial purposes.
6.3 Contributions must not violate intellectual property rights, applicable laws, or be harmful, defamatory, obscene, or offensive.
6.4 Hugo Writes may remove, edit, or relocate any Contribution at its discretion.
7. Intellectual Property
7.1 All Intellectual Property Rights in Hugo Writes, including software, content, trademarks, logos, and designs, remain with Hugo Writes.
7.2 Users may access content for personal, non-commercial use only. No part of the Services may be reproduced, distributed, or exploited without explicit permission.
7.3 Unauthorized use of any content or trademarks constitutes a material breach of these Terms and may result in immediate termination of your account.
8. Purchases, Subscriptions, and Payment
8.1 Paid Services are subscription-based, billed in the currency specified at purchase. Subscriptions auto-renew unless canceled before the renewal date.
8.2 All payments are non-refundable due to immediate access and resource allocation.
8.3 Users may cancel subscriptions at any time. Cancellation does not provide refunds or credits for already billed periods.
8.4 Hugo Writes may adjust pricing, features, or service offerings at any time. Changes take effect at the next billing cycle.
8.5 Users may not create multiple accounts to bypass usage limits or trial restrictions.
8.6 Taxes, duties, and any additional fees are the responsibility of the user.
9. Prohibited Activities
Prohibited conduct includes, but is not limited to:
Illegal activities, copyright infringement, or academic dishonesty.
Uploading viruses, malware, or harmful content.
Automated use (bots, scripts) without permission.
Misleading, harassing, or harmful behavior toward Hugo Writes or other users.
Attempting to bypass security or usage restrictions.
Creating multiple accounts to exploit free trials or subscriptions.
10. Disclaimers
10.1 Services are provided “AS IS” and “AS AVAILABLE.” You assume all risk associated with their use.
10.2 Hugo Writes disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
10.3 We do not guarantee the accuracy, completeness, or uninterrupted availability of the Services. Any reliance on AI-generated outputs or other content is at your own risk.
11. Limitations of Liability
11.1 Hugo Writes, its officers, employees, or agents are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.
11.2 Your total liability shall not exceed the amount paid by you, if any, for accessing the Services. Some jurisdictions do not allow limitations on liability; the above limitations may not apply to you.
12. Indemnification
You agree to defend, indemnify, and hold harmless Hugo Writes, Naratour d.o.o., its affiliates, officers, agents, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, your Contributions, or your violation of these Terms.
13. User Data
13.1 Hugo Writes will maintain data you provide solely to operate and manage the Services.
13.2 Users are responsible for maintaining backups. Hugo Writes is not liable for any data loss or corruption.
14. Dispute Resolution
14.1 Informal Negotiations: Before initiating formal proceedings, disputes must first be attempted to resolve informally within 30 days of written notice.
14.2 Binding Arbitration: If unresolved, disputes will be settled through binding arbitration under applicable rules. Arbitration is individual; class or representative actions are prohibited.
Claims must be brought within two years of the event. Invalid portions of this provision do not affect the remainder.
15. Corrections
Hugo Writes may correct errors, inaccuracies, or omissions in the Services at any time without prior notice.
16. Termination
16.1 Users may discontinue use at any time.
16.2 We may suspend or terminate accounts for violations or legal obligations without prior notice.
16.3 Termination does not relieve users of accrued obligations.
17. California Users
California residents may contact state consumer protection offices for unresolved issues.
18. Miscellaneous
18.1 These Terms, along with the Privacy Policy and any supplemental agreements, constitute the entire agreement.
18.2 Failure to enforce any provision does not constitute a waiver.
18.3 Invalid provisions are severable and do not affect the remainder.
18.4 No joint venture, partnership, employment, or agency relationship is created.
